These Terms of Service ("Terms") govern your use of the website located at afosi.org (the "Site"), operated by Action for Sustainability Initiative (AFOSI), a non-governmental organization registered in Kenya (registration no. OP.218/051/12-0101/8065), with offices at Manga Hse, Kiambere Rd, Upper Hill, Nairobi, Kenya ("AFOSI," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
AFOSI is a Kenya-based technology NGO, founded in 2012, driving sustainable change in Sub-Saharan Africa by equipping youth and women with AI-driven tools, green skills, and access to global climate finance. Our programs span six pillars (health, education, environment, livelihoods, leadership & governance, and humanitarian work) and we build and run our own digital platforms, including the Kiongozi Platform, Kenya Youth Climate Hub, Afosi Hub, and the Kiongozi Chat mobile app. The Site provides information about our programs, platforms, opportunities, and news, and a way to donate to and partner with us.
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of it. You must not:
We may suspend or restrict access to the Site, in whole or in part, at our discretion, without notice.
Where the Site allows you to apply for programs, opportunities, volunteering, or partnerships, you agree that the information you submit is accurate and that you are entitled to submit it. Submitting an application does not guarantee selection, funding, or participation. We may contact you using the details you provide to process your application.
Donations made through the Site are processed by third-party payment providers, currently Paystack, supporting card and mobile money payments, including M-Pesa. By donating, you also agree to our Donation & Refund Policy, which sets out when a donation may be refunded.
Donations are used at AFOSI's discretion to further our programs and organizational mission, unless a donation is expressly earmarked and we have separately agreed in writing to honor that restriction.
We do not store your card or mobile money credentials; these are handled directly by our payment processor under their own security and compliance standards. See our Privacy Policy for how we handle your information.
Unless otherwise stated, all content on the Site (text, graphics, logos, photos, and the "AFOSI" name and mark) is owned by or licensed to AFOSI and protected by Kenyan and international intellectual property law. You may view, download, and print content from the Site for personal, non-commercial use, provided you keep all copyright and other proprietary notices intact. Any other use, including reproduction for commercial purposes or redistribution, requires our prior written consent.
The Site links to independently operated platforms we build or support, including Kenya Youth Climate Hub, Afosi Hub, and Kiongozi ya Vijana, as well as to third-party sites such as our social media pages and payment processors. We do not control these third-party sites and are not responsible for their content, policies, or practices. Use of those platforms is governed by their own terms.
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses, or that any information on it is complete, accurate, or up to date.
To the fullest extent permitted by Kenyan law, AFOSI will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, the Site. Nothing in these Terms limits our liability for fraud, or for anything else that cannot be excluded or limited under Kenyan law.
You agree to indemnify and hold AFOSI, its staff, and volunteers harmless from any claim or demand, including reasonable legal fees, arising out of your misuse of the Site or your breach of these Terms.
We may update these Terms from time to time to reflect changes in our practices or for legal or operational reasons. The "Effective date" above will be updated accordingly. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Kenya. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Kenya.
